Nothing here removes rights you have under law that cannot be excluded.
1. About these terms
These terms govern your use of Pollyana Academy Ltd's services: The Summer Thinking Space (live one-to-one sessions) and Held to Think (an online maths companion). By creating an account or buying a service, you agree to these terms.
2. Who may use the services
You must be the parent or legal guardian of the child, aged 18 or over, and have authority to act for the child. You hold the account. The child works on Held to Think under your account and supervision and does not contract with us. You are responsible for your account and for the information you provide.
3. What the services are, and are not
Our services help a child develop and trust their own mathematical thinking. They are educational support. They are not a diagnostic, therapeutic, medical or safeguarding service, and they do not guarantee any grade or outcome. Held to Think deliberately does not give answers or mark work right or wrong; it helps a child reach and check their own answers. We do not provide medical, psychological or emergency advice.
4. Your responsibilities
You agree to provide accurate information, to share only what you are entitled to share, to keep to learning information and leave out unnecessary personal detail, and not to provide information about other people without authority. You agree to use the services for your own child and not to misuse, copy or resell them.
5. Acceptable use
You and your child agree not to attempt to disrupt, reverse engineer, scrape or interfere with the service, and not to use it unlawfully. We may suspend access where these terms are breached or where we reasonably believe it is necessary to protect a child or the service.
6. Intellectual property
The Pollyana Academy method, the content and the materials are our intellectual property or licensed to us. You receive a personal, non-transferable right to use them for your own child while your account is active. You may not copy, distribute or create derivative works from them.
7. Payment, pricing and subscriptions
Prices are shown at purchase. The live Summer Thinking Space is bought as a one-off package. Held to Think, when available, is a monthly subscription that continues until you cancel. Cancellation and refunds are governed by our Refund and Cancellation Policy and by your statutory rights. We may change prices for future purchases or renewals with notice.
8. Safeguarding
If we identify a possible risk to a child, we may pause the service and review the matter personally, in line with our Privacy Policy. We will act calmly and proportionately and will not provide emergency advice through the product.
9. Availability
We aim to provide a reliable service but do not guarantee uninterrupted availability. We may update, suspend or withdraw features, and will give reasonable notice of material changes where we can.
10. Our liability
We do not exclude or limit liability where it would be unlawful to do so, including for death or personal injury caused by negligence, or for fraud. Subject to that, we are not liable for indirect or unforeseeable loss, and our total liability connected with a service is limited to the amount you paid for that service. Nothing in these terms affects your statutory rights as a consumer.
11. Privacy
Our use of personal information is described in our Privacy Policy, which forms part of your agreement with us.
12. Changes to these terms
We may update these terms as the service develops. The current version and date are shown above, and we record your acceptance.
13. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, without affecting any statutory protection available to you in your country of residence.
